Terms of Service
Draft for legal review. These terms are a placeholder and have not been reviewed by a lawyer. They will be replaced before eSignIt is generally available.
1. The service
eSignIt lets an organisation ("Customer") send documents to people ("Signers") for electronic signature, store the completed documents, and deliver them to systems the Customer connects.
2. Accounts
The person who registers a company accepts these terms on its behalf and confirms they're authorised to. Customers are responsible for the people they invite, their sign-in settings, and keeping credentials secure. eSignIt may review and approve new companies before they can send.
3. Acceptable use
- Only send documents you're entitled to send, to people who expect them.
- No phishing, spam, impersonation, malware or unlawful content. eSignIt may pause sending, for example when bounce or complaint rates are high.
- Some documents can't legally be signed electronically (for example wills, some court, family-law and real-estate documents). The Customer decides whether e-signature is suitable.
4. Customer data
Documents and their contents belong to the Customer. eSignIt processes them only to provide the service, as described in the Privacy Policy and a data processing agreement. Completed documents are retained for the period the Customer chooses (by default seven years) and can't be deleted earlier.
5. Electronic signatures
eSignIt records consent, verification and signing events and seals completed documents so changes are detectable. Whether a signature is valid for a given purpose depends on the law that applies; eSignIt doesn't give legal advice.
6. Plans and fees
Plans have monthly limits. Paid plans, fees and billing terms will be set out when they become available.
7. Availability, liability, termination
To be completed in legal review: service levels, warranties, limitation of liability, indemnities, suspension and termination, governing law.
